Please read these Terms of Service ("Terms", "Agreement") carefully before using the Fanvult platform. These Terms constitute a legally binding agreement between you ("User", "you", "your") and Fanvult ("Company", "we", "us", "our"), governing your access to and use of the website located at fanvult.com (the "Site"), including all content, functionality, and services offered on or through the Site.
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.
1. Overview of Services
Fanvult operates as a digital marketplace that connects content creators ("Creators") with customers ("Buyers") for the sale and distribution of digital products. The platform facilitates the listing, purchasing, payment processing, and delivery of digital goods.
Our services include but are not limited to:
- Hosting and displaying digital product listings on behalf of Creators
- Processing secure payments through third-party payment providers
- Generating and delivering unique, time-limited download links to Buyers
- Providing customer support for order-related inquiries
- Maintaining analytics and reporting tools for business operations
Fanvult acts as an intermediary platform. We do not create, own, or endorse any of the digital products listed on the Site unless explicitly stated. Each Creator is solely responsible for the content, quality, and accuracy of their product listings.
2. Eligibility
To use the Site and make purchases, you must:
- Be at least 18 years of age, or the age of legal majority in your jurisdiction
- Have the legal capacity to enter into a binding agreement
- Provide truthful, accurate, and complete information when making a purchase
- Not have been previously suspended or removed from the platform
By using the Site, you represent and warrant that you meet all of the above eligibility requirements. If you are using the Site on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
3. Account & Access
Certain features of the Site may require you to provide personal information such as an email address. You are responsible for maintaining the confidentiality of any credentials or access tokens associated with your purchases.
You agree to:
- Provide accurate and current information during checkout and support interactions
- Not share download links, access tokens, or purchased content with unauthorised parties
- Notify us immediately if you suspect any unauthorised use of your purchase credentials
- Accept responsibility for all activity that occurs under your email or access credentials
We reserve the right to refuse service, terminate access, or cancel orders at our sole discretion if we suspect fraudulent activity or violation of these Terms.
4. Products & Services
Fanvult facilitates the sale of digital products across various categories, including but not limited to:
- Photo & Video Presets — Professional editing presets compatible with Adobe Lightroom, Photoshop, Premiere Pro, and similar software
- Digital Templates — Ready-to-use templates for content planning, social media, branding, and business purposes
- Educational Guides — Step-by-step guides, tutorials, and instructional content in digital format
- Exclusive Content Bundles — Curated collections of premium digital content from verified creators
- Creative Assets — Graphics, overlays, fonts, and other digital creative resources
Product descriptions, including features, compatibility, and specifications, are provided by the Creator. While we strive to ensure accuracy, Fanvult does not guarantee that all product descriptions are complete, current, or error-free.
Product Availability
All products are subject to availability. We reserve the right to discontinue, modify, or limit the availability of any product at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of a product.
5. Pricing & Payment
All prices displayed on the Site are in Australian Dollars (AUD) unless otherwise indicated. Prices include GST where applicable.
Payment Processing
Payments are processed through secure, PCI-DSS compliant third-party payment processors. By submitting a payment, you authorise us and our payment processor to charge the payment method you provide for the total amount of your order.
We accept payments via major credit cards, debit cards, and other payment methods as supported by our payment processor. You represent and warrant that:
- You are the authorised holder of the payment method used
- All payment information provided is accurate and complete
- You have sufficient funds or credit to complete the transaction
Price Changes
We reserve the right to change prices at any time. Price changes will not affect orders that have already been completed. Promotional or discounted pricing may be offered at our discretion and may be subject to additional terms or time limitations.
Currency & Tax
If you are purchasing from outside Australia, your financial institution may apply currency conversion fees or additional charges. These fees are your responsibility and are not controlled by Fanvult. We are not responsible for any additional taxes, duties, or charges imposed by your local jurisdiction.
6. Digital Delivery
Upon successful payment, you will receive a confirmation email containing a unique, secure download link. This email is sent to the address provided at checkout.
Download Links
- Download links are unique and non-transferable — they are intended for your personal use only
- Links may be time-limited and will expire after the designated access period
- Links may have usage limits to prevent unauthorised distribution
- Once expired, links cannot be reactivated without contacting support
Delivery Issues
If you do not receive your download link within 15 minutes of purchase, please check your spam or junk folder. If the issue persists, contact our support team with your order email address and we will resolve the issue promptly. Delivery failures due to incorrect email addresses provided by the Buyer are not the responsibility of Fanvult.
File Formats
Digital products are delivered in various file formats depending on the product type (e.g., .xmp, .dng, .lrtemplate, .pdf, .zip). It is your responsibility to ensure you have compatible software to use the purchased product. Compatibility requirements are listed on each product page where applicable.
7. License & Usage Rights
When you purchase a digital product through Fanvult, you are granted a limited, non-exclusive, non-transferable, revocable license to use the product for personal, non-commercial purposes unless otherwise specified in the product listing.
You MAY:
- Use the product for personal projects, social media, and portfolio work
- Install the product on devices you personally own and control
- Create derivative works using the product (e.g., edited photos using presets)
- Use the product indefinitely after download, subject to these Terms
You MAY NOT:
- Resell, sublicense, rent, lease, or redistribute the product in any form
- Share the product files or download links with any third party
- Claim authorship or ownership of the original product
- Include the product files (unmodified) in any product you sell or distribute
- Use the product in any way that violates applicable laws or regulations
- Reverse-engineer, decompile, or extract source components from the product
Violation of these license terms may result in termination of your license, removal of your access, and potential legal action.
8. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the compilation thereof, is the property of Fanvult or its content suppliers and is protected by Australian and international copyright, trademark, and intellectual property laws.
Digital products sold through the Site remain the intellectual property of their respective Creators. Your purchase constitutes a license to use the product, not a transfer of ownership or intellectual property rights.
The Fanvult name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fanvult. You may not use such marks without our prior written permission.
9. User Conduct
By using the Site, you agree to conduct yourself in a lawful and respectful manner. You agree not to:
- Use the Site for any purpose that is unlawful, harmful, or prohibited by these Terms
- Attempt to gain unauthorised access to any part of the Site, its servers, or connected systems
- Introduce viruses, trojans, worms, or other malicious software to the Site
- Scrape, crawl, or use automated tools to extract data from the Site without permission
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Site or servers or networks connected to the Site
- Circumvent, disable, or otherwise interfere with security-related features of the Site
- Use the Site to transmit unsolicited commercial communications (spam)
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
- Attempt to reverse-engineer the download system or token-based access mechanism
We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including reporting such conduct to law enforcement authorities.
10. Refunds & Cancellations
Due to the nature of digital products, all sales are generally considered final once the product has been delivered. However, we recognise that issues may arise and offer refunds under specific circumstances as outlined in our Refund Policy.
Refund-eligible scenarios include:
- Non-delivery of the purchased product (download link not received)
- Corrupted or non-functional files that cannot be replaced
- Duplicate charges for the same product
- Product materially different from its listing description
Refund requests must be submitted within 14 days of the original purchase date through our support page. Refunds are processed to the original payment method and may take 5-10 business days to appear on your statement.
We reserve the right to deny refund requests that do not meet the criteria outlined in our Refund Policy, or where we reasonably suspect fraud or abuse of the refund process.
11. Privacy & Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Site, you consent to the collection and processing of your data as described in the Privacy Policy. Key data practices include:
- We collect email addresses for order processing and product delivery
- Payment information is processed by our PCI-compliant payment provider and is never stored on our servers
- We use anonymous analytics to improve our services
- We do not sell or share personal data with third parties for marketing purposes

13. Disclaimers
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permissible under applicable law, Fanvult disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Site will be uninterrupted, timely, secure, or error-free
- Warranties regarding the accuracy, reliability, or completeness of any content on the Site
- Warranties that defects will be corrected or that the Site is free of viruses or harmful components
You acknowledge that your use of the Site is at your sole risk and that you are solely responsible for any damage to your computer system or loss of data resulting from your use of the Site or download of any content.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Fanvult, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from your access to or use of (or inability to access or use) the Site
- Damages resulting from any conduct or content of any third party on the Site
- Damages resulting from unauthorised access, use, or alteration of your transmissions or content
- Any other matter relating to the Site
In no event shall Fanvult's total aggregate liability to you for all claims arising out of or relating to the use of the Site exceed the amount you paid to Fanvult in the twelve (12) months preceding the event giving rise to the liability, or fifty Australian dollars (A$50), whichever is greater.
15. Indemnification
You agree to defend, indemnify, and hold harmless Fanvult and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Site or any products purchased through the Site
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you submit or transmit through the Site
- Your negligent or wrongful conduct
16. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination:
- Your right to use the Site will immediately cease
- Any licenses granted to you under these Terms will be revoked
- We may delete or deny access to any pending downloads or unused access tokens
- Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in New South Wales, Australia, for the resolution of any disputes arising out of or relating to these Terms or the Site.
18. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or the Site, the parties agree to first attempt to resolve the dispute through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal dispute resolution.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Fanvult.
19. Modifications to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, by posting the updated Terms on this page with a revised "Last updated" date.
Your continued use of the Site after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new terms, you must stop using the Site.
20. Severability & Waiver
Severability: If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Waiver: The failure of Fanvult to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Fanvult regarding the use of the Site and supersede all prior agreements, communications, and understandings, whether written or oral.
